ORIGINE PARIS Ethical & Bespoke Fine Jewellery

Article 1: Company Information

Origine Paris is an ethical and responsible fine jewellery house, specialising in the creation of jewellery crafted from recycled 18-carat gold and lab-grown diamonds. Each piece is designed and made with respect for people and the environment, combining artisanal craftsmanship with exceptional materials.

Origine Paris does not operate a physical boutique open to the public and does not, at this time, have an online sales website. All orders are handled exclusively by appointment, in accordance with the terms described in Article 2.

Article 2: Scope of Application

These General Terms and Conditions of Sale (hereinafter the "GTC") govern all commercial relations between Origine Paris and its clients, whether for pieces from existing collections or bespoke creations.

Placing an order implies full and unreserved acceptance of these GTC, which the client acknowledges having read prior to placing any order.

Article 3: Contact & Order Procedure

3.1: Getting in touch

All purchasing steps are carried out exclusively by appointment, through one of the following channels:

  • Video conference appointment (Zoom, Google Meet or equivalent)
  • Telephone appointment
  • In-person appointment, by express invitation from Origine Paris
  • Preliminary exchange by email for information requests

No firm order can be placed without written, formal confirmation from Origine Paris.

3.2: How the appointment unfolds

During the appointment, our team takes the time to understand your project, present the available materials and creations, and define together the characteristics of the piece you wish for. We approach every project with enthusiasm and do our utmost to respond favourably.

Every order is initially registered without firm commitment, in order to allow a study of technical, aesthetic and ethical feasibility.

3.3: Right to decline an order

Origine Paris reserves the right to decline any order, without obligation to justify its decision, in particular in the following cases:

  • The request consists of reproducing, imitating or copying a protected model belonging to another house or brand (see Article 4);
  • The project is technically unfeasible within our manufacturing process;
  • The request is contrary to the ethical commitments and values of Origine Paris;
  • The conditions or timelines requested cannot reasonably be guaranteed.

In the event of a decline, the client will be informed as soon as possible, with no fees or penalty.

Article 4: Intellectual Property & Creative Ethics

4.1: Respect for third-party intellectual property

Origine Paris attaches fundamental importance to respecting creation and intellectual property. As such, the house categorically refuses to produce any piece constituting the copy, reproduction or imitation, even partial or adapted, of a creation belonging to another brand, jewellery house or designer.

Any request of this kind will be systematically declined. If the spirit of a piece inspires the client, Origine Paris may propose an entirely original creation drawing freely from it, without infringing the rights of third parties.

4.2: Exclusive ownership of Origine Paris creations & designs

All drawings, sketches, mock-ups, visuals and models conceived by Origine Paris remain the exclusive intellectual property of Origine Paris, whether produced in the context of a bespoke exchange or not. This ownership is acquired from the moment of creation, independently of any firm order and whatever the outcome of the exchanges.

A client who orders a bespoke piece acquires, through full payment, ownership of the physical piece manufactured. The drawings and models that generated it nevertheless remain the property of Origine Paris. The house thus reserves the right to draw inspiration from them, to develop variations of them, or to offer similar pieces to other clients, including publishing them online. The fact that a piece resulting from a bespoke project appears on the website or media of Origine Paris does not constitute a violation of the client's rights.

Under no circumstances may the client use, reproduce, transmit or entrust to a third party the drawings, sketches or mock-ups produced by Origine Paris in order to have them manufactured elsewhere. Any breach of this rule constitutes a violation of the intellectual property rights of Origine Paris and may give rise to legal proceedings.

Article 5: Bespoke Orders

5.1: Definition

A bespoke order is considered to be any piece involving personalisation compared with the existing collections. This includes in particular:

  • The engraving of a text, a date, a first name or any other personalised element;
  • The modification of the dimensions, materials or stones of a collection piece, including any specific resizing requested by the client;
  • The design and production of an entirely original piece, created specially for the client.

5.2: Non-application of the right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the fourteen (14) day right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised.

Any bespoke order within the meaning of Article 5.1 is therefore firm and final upon its written confirmation by Origine Paris and payment of the deposit. It may not be subject to any withdrawal, cancellation or refund.

Article 6: Collection Pieces & Right of Withdrawal

6.1: Scope of the right of withdrawal

The right of withdrawal applies exclusively to standard, non-personalised collection pieces. Any specific resizing, engraving or modification requested by the client at the time of order turns the piece into a personalised item, thereby excluding the right of withdrawal in accordance with Article L.221-28 of the French Consumer Code.

For purchases of non-personalised collection jewellery made remotely (telephone, video conference, email), the client benefits from a right of withdrawal of fourteen (14) calendar days from receipt of the piece, in accordance with Articles L.221-18 et seq. of the French Consumer Code.

6.2: Conditions for exercising the right of withdrawal

To exercise the right of withdrawal, the client notifies Origine Paris of their decision in writing (email to contact@origineparis.com) within fourteen (14) calendar days following receipt of the piece.

The piece must be returned under the following conditions:

  • In its original condition, unworn, with no sign of use;
  • In its original case, together with all its documents (diamond certificate(s), certificate of authenticity and any other document provided on delivery);
  • To the following address: Origine Paris, 231 rue Saint-Honoré, 75001 Paris, France;
  • By secured shipping with declared value and appropriate insurance, return costs being solely the client's responsibility.

Any sign of use, micro-scratches or damage found on receipt of the return will result in either cancellation of the refund or a deduction corresponding to the restoration costs, assessed by Origine Paris and communicated to the client before any decision.

The full refund of the price paid (deposit included) is made within fourteen (14) days following receipt of the return, subject to the piece complying with the conditions above.

6.3: Exchanges

Beyond the legal withdrawal period, Origine Paris may, as a commercial gesture and subject to the express acceptance of the Maison, consider exchanging a collection piece for another piece of equal or greater value.

Any exchange request must be made in writing to contact@origineparis.com within a maximum of thirty (30) calendar days following receipt of the piece. The exchange is subject to the same return conditions as those defined in Article 6.2 (as-new condition, original case, certificates included). Any price difference will be charged to the client. No refund is made in the event of an exchange for a piece of lower value.

6.4: Expired period

After the fourteen (14) calendar day period, any cancellation at the client's initiative entails the loss of the deposit paid, which remains acquired by Origine Paris as a fixed indemnity, unless otherwise agreed in writing.

Article 7: Prices & Payment Terms

7.1: Prices & validity of quotes

Prices are expressed in euros (€), inclusive of all taxes. They are communicated during the appointment and confirmed in writing before any production.

Quotes issued by Origine Paris are valid for fifteen (15) calendar days from their date of issue, given the volatility of precious metal and stone prices. After this period, the price may be revised to reflect prevailing market conditions. The client will be informed of any adjustment before final validation of the order.

7.2: Commitment deposit

Upon confirmation of the order, a commitment deposit of 30% (thirty per cent) of the total amount inclusive of tax is payable, in order to initiate production and the sourcing of materials.

The balance, being 70% of the total amount inclusive of tax, is due before the piece is handed over to the client.

For bespoke orders, the deposit is non-refundable once production has begun. For collection orders placed remotely, the deposit is refunded in the event of withdrawal exercised within the fourteen (14) calendar day legal period (see Article 6). After this period, it remains acquired by Origine Paris.

7.3: Payment methods

Accepted payment methods are specified at the time of order confirmation. No order will be put into production until the deposit has been received and cleared.

Article 8: Production & Delivery Timelines

Production timelines

Origine Paris undertakes to produce each piece with the greatest care and as promptly as possible. As a guide, production timelines are as follows:

  • Collection pieces (without personalisation): approximately 8 to 12 weeks from receipt of the deposit;
  • Bespoke pieces: timeline determined on a case-by-case basis, according to the complexity of the project, and communicated in writing at order confirmation.

In the event of an urgent request, Origine Paris will do its best to accommodate it, subject to feasibility.

Certain orders may require additional time, in particular when the sourcing of specific diamonds or stones proves more complex. In such cases, the client is informed as soon as possible and a new schedule is agreed by mutual consent.

Delivery

These timelines are communicated as a guide and do not constitute a firm contractual commitment by the Maison. No penalty, indemnity or compensation may be claimed on account of a delivery delay, except in the case of gross negligence or wilful misconduct established against Origine Paris.

Article 9: Legal Warranties

9.1: Legal warranty of conformity

In accordance with Articles L.217-4 et seq. of the French Consumer Code, Origine Paris is required to deliver goods that conform to the contract and is liable for defects of conformity existing at the time of delivery. The legal warranty of conformity applies independently of any commercial warranty.

In the event of a defect of conformity, the client may choose between repair or replacement of the piece, subject to the cost conditions provided by law. If neither repair nor replacement is possible, the client may return the piece and obtain a full refund of the price.

9.2: Warranty against hidden defects

In accordance with Articles 1641 et seq. of the French Civil Code, Origine Paris is liable for hidden defects in the item sold that render it unfit for its intended use, or that so diminish that use that the client would not have acquired it had they known of them. The client may then choose between returning the piece for a refund of the price, or keeping the piece for a partial refund.

9.3: Loss of warranties in the event of third-party intervention

Any technical intervention, repair or resizing carried out by a third party not approved by Maison Origine Paris entails the immediate loss of the legal warranty of conformity and the warranty against hidden defects referred to in Articles 9.1 and 9.2. Origine Paris cannot be held responsible for damage resulting from such intervention.

9.4: After-sales service & care

Origine Paris offers a maintenance, cleaning and restoration service for your jewellery. The conditions and pricing of this service are communicated on request during a dedicated appointment.

Article 10: Personal Data

The data collected in the context of your order and our client relationship is processed by Origine Paris solely for the processing and follow-up of that order. It is not transferred to third parties for commercial purposes.

In accordance with the GDPR, you have rights of access, rectification, erasure, objection, restriction and portability, as well as the right to lodge a complaint with the CNIL. To exercise them: contact@origineparis.com.

Article 11: Governing Law & Dispute Resolution

These GTC are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent courts within the jurisdiction of Origine Paris's registered office shall have sole jurisdiction. In accordance with the French Consumer Code, the client may resort to a consumer mediator under the conditions provided by law.
